UNDER ARMOUR (UA) REWARDS (FORMERLY KNOWN AS ARMOUR CLUB) PRIVACY POLICY
A. General Overview
1. Under Armour, Inc., UA Sports (SEA) Pte Ltd and their affiliates (collectively referred to herein as “UA”, “Under Armour”, “we”, “our” or “us”) are committed to protecting the privacy of visitors and users of our websites, online forms and mobile applications. Under Armour Inc. and UA Sports (SEA) Pte Ltd shall both be data controllers (meaning they shall determine the purposes for which and the means by which personal data is collected, used, held, processed and/or disclosed) for all Personal Data (as defined below). Each of them may act singly or jointly in respect of the Personal Data collected but always in accordance with this Privacy Policy. “Personal Data” refers to means data, whether true or not, about an individual who can be identified from that data or from that data and other information to which we have or are likely to have access.
2. The prevailing terms and provisions of the Under Armour Global Privacy Policy, accessible at PRIVACY CENTER, are incorporated in this Privacy Policy and made a part hereof as if the same were fully set forth herein. In the event of any inconsistency, conflict or discrepancy between the Under Armour Global Privacy Policy and this Privacy Policy, the terms of this Privacy Policy shall prevail.

This Privacy Policy outlines how we collect, use and/or disclose your Personal Data in connection with the UA Rewards programme, including when you use and access our websites (including but not limited to underarmour.com.sg, underarmour.com.my, underarmour.com.th and underarmour.com.hk) (“Websites”) and corresponding mobile applications (including but not limited to the UA Rewards Member mobile application) (“Mobile Apps”). 4. Please read this Privacy Policy carefully before using or proceeding to access any of our Websites or Mobile Apps. By interacting with us, submitting information (including your Personal Data), or signing up for any products or services offered by us in connection with or under the UA Rewards Programme, you agree and consent to us collecting, using and/or disclosing your Personal Data in the manner and for any of the purposes set forth in this Privacy Policy and the Under Armour Global Privacy Policy. If you are under the age of majority (in your respective country) and are not capable of entering into a transaction by yourself, or are not competent and/or permitted to give your consent under applicable law, please obtain consent from your parent or guardian before submitting any Personal Data to us.
5. We reserve the right to update, amend or modify this Privacy Policy from time to time, and to send you notifications of updates to this Privacy Policy in any form as we may deem appropriate. B. Collection of Personal Data
7. Generally, in relation to the UA Rewards programme, we collect Personal Data (including those listed on the Under Armour Global Privacy Policy, accessible Here) when you:
7.1 submit any form, details or information including but not limited to when you apply and establish an account to be an UA Rewards Member;
7.2 access, visit or use any of our electronic services, or interact with us via our Websites and/or Mobile Apps or use any services, features and/or functions on the same;
7.3 register or make any purchase of products and/or services on any of our Websites, Mobile Apps and retail stores;
7.4 sign up or request to be included in an email or other mailing list;
7.5 register or sign up for any Under Armour events, competitions, challenges or other activities; and/or
7.6 when you submit your Personal Data to us for any other reason.
8. Provision of your Personal Data is voluntary and you may choose not to provide us with your Personal Data. However, if you choose not to provide us with your Personal Data:
8.1 you may not be able to participate in the UA Rewards programme;
8.2 we may also not be in a position to provide our products or services to you, administer any contractual relationship already in place, or perform or conclude any existing or prospective agreement(s); and/or
8.3 it may result in the termination of any agreement(s) you have with us.
C. Mailing list, posting comments and third-party services
9. Mailing Lists & Service Emails - We maintain a mailing list, in order to provide subscribers with relevant information. In order to sign up to receive regular emails from our mailing list, you will need to submit information to us including a valid email address and other information such as where you are located and your interests. We may use the information provided by you in aggregate form in order to assess general user interest in various Under Armour and third-party products and services. Unless otherwise expressly provided in this Privacy Policy, we will not disclose or share your Personal Data or information with any other third-party organization who are not our service providers (e.g. our IT services providers). If you choose to sign up or request to be added to a mailing list, you may receive regular emails from our Websites and/or Mobile Apps. We may from time to time track your email usage employing the use of tracking technologies such as tracking pixels (including as set out in the Under Armour Global Privacy Policy, Tracking Technologies in a continued effort to assess the effectiveness of our mailing list, to understand your preferences and to personalise your experience and recommendations, delivering advertisements and information which may be of interest to you, and to improve our services. Generally, the communications from us will consist of content from our Websites and/or Mobile Apps, but we may also send out emails or content from third party sponsors. As editorial independence is important to us, you can be sure that we will always mark third party-sponsored content as such, including in the emails. If you do not wish to receive emails containing promotional, marketing or advertising materials, please do not sign up for the mailing lists. You may also choose to unsubscribe to our mailing lists at any time. To unsubscribe, you will need to:

10. Your request for us to cease sending you emails or messages containing promotional, marketing advertising materials will only take effect within ten (10) business days from the date we receive your request. Similarly, if you wish to inquire about or to amend any Personal Data held by us, please refer to paragraph 25 below for our Data Privacy Officer/Personal Information Controller’s contact information.
11. Comment Service and Account Information – In order to further enhance your user experience when using our Websites and/or Mobile Apps, we may allow you to post your comments on our Websites and/or Mobile Apps, to facilitate discussions and contribution to discussion topics posted on our Websites and/or Mobile Apps. In order to contribute and post your comments, you will need to sign up for this service by providing us with your information (which may include your Personal Data) or alternatively, by setting up an anonymous account. We may use the information provided by you to:
11.1 ensure that the comments posted or contributed by you are compliant with and not in violation of our Terms of Use, which is accessible Here ;
11.2 to send you notifications where necessary; and/or
11.3 to pick out your topics of interest.
12. Third party services - You may link your account to certain third party services and to do so, you may be required to provide your login information in order to access and use such third party services. If you login via a third party service, we will receive an identifying token from that service, which will allow us to access certain information from your account on that service, so that we can, for example, send you a message through that service. We do not receive or store your passwords from such third party services and, unless otherwise expressly provided in this Privacy Policy, we will not pass your information (including your Personal Data) to such third party service providers when you register via a third party service, except in aggregate form. In signing up for an account, you will be required to provide us with your email address. You should ensure that all Personal Data submitted to us (including your email address) is complete, accurate, true and up-to-date. If you submit a request to us to change the password of your account, we will respond by sending a link for a new password to the email address provided by you and reflected on our records only.
D. Purposes for the collection, use and/or disclosure of Personal Data
13. In addition to the purposes set out in the Under Armour Global Privacy Policy, we collect, use and/or disclose your Personal Data for the following purposes:
13.1 responding to, processing and handling your queries, feedback, suggestions and requests;
13.2 facilitating your access to and use of our Websites and/or Mobile Apps;
13.3 providing you with a better shopping experience whether online or otherwise;
13.4 processing your registration to become an UA Rewards Member;
13.5 verifying your identity;
13.6 if you have indicated that you consent to receiving marketing or promotional information, sending you communications and information regarding any ongoing promotions or Under Armour news;
13.7 fulfilling your requests or purchase of goods and/or services;
13.8 facilitating future works at the store or on our Websites and/or Mobile Apps;
13.9 evaluating your preferences and updating your profile, so that we may serve you better;
13.10 facilitating any sale, merger, reorganization, restructuring or similar event involving any of our business or assets;
13.11 for any such purpose as may be allowed by law; and/or
13.12 any other purpose relating to or reasonably necessary for any of the above.
E. Disclosure of Personal Data
14. We consider your Personal Data to be a vital part of our relationship with you. We may share your Personal Data (including those listed on the Under Armour Global Privacy Policy, accessible Here) , including for the purposes set out in the UA Global Privacy Policy and listed at paragraph 14 above, to the following entities or parties, which may not be located in your country and may be located in Singapore, the Unites States of America, Canada, Japan, Malaysia, Thailand, Hong Kong, Australia and/or other countries including (but not limited to) where we our global offices or service providers are located:
14.1 our subsidiaries and affiliates principally engaged in the development, marketing, sale and distribution of sports, casual and performance apparel, footwear, accessories and equipment, as well as organising and conducting sports-related events and activities, and ad partners, business partners, vendors and suppliers related to our above business, operations and activities;
14.2 vendors, contractors or other third party service providers who provide services to us, including services relating to marketing, fulfilment and delivery of orders, mailing information, maintaining of databases and the processing of payments. These third party service providers are subject to confidentiality obligations and may only use your Personal Data to perform the necessary functions and not for other purposes except those listed at paragraph 14 above. We also require such third-party service providers to implement and maintain reasonable security measures to safeguard the confidentiality, security and integrity of your Personal Data; and
14.3 any law enforcement, government or regulatory bodies, lawful authorities, or other authorized third parties in order to comply with laws, regulations, court orders, or other legal obligations or to assist in an investigation, to protect and defend our rights and property, or the rights or safety of third parties, to enforce this Privacy Policy, or agreements with third parties.
15. Your Personal Data will not be sold, transferred or otherwise conveyed to unaffiliated third parties or third parties who are not our service providers without your consent.
F. Co-branded websites
16. If you submit or input your Personal Data on a co-branded registration website, relating, for example, to a contest that is co-sponsored by us and one of our co-brands or partner company, then your Personal Data may be collected, used and/or disclosed by us and such other co-brand or partner company.
17. While we will only collect, use and/or disclose your Personal Data in accordance with this Privacy Policy, such other co-brand or partner company's collection, use and/or disclosure of your Personal Data may be subject to a separate privacy policy that is administered by it. We are not responsible for any such co-brand or partner company’s collection, use and/or disclosure of your Personal Data and its privacy practices. We encourage you to review the privacy policy of such co-brand or partner company before providing your Personal Data on any such co-sponsored website.
G. Third party sites and embedded content
18. Our Websites and/or Mobile Apps may contain links to other websites operated by third parties. Some of these links may be affiliate marketing links encoded by third parties. Such third parties do not collect any personally identifiable information unless you visit the referenced site.
19. Please be aware that we are not responsible for the privacy practices of such third party sites. We encourage you to read the applicable privacy policy of these third party sites. This Privacy Policy applies solely to Personal Data that is collected, used and/or disclosed by us on our Websites and Mobile Apps. Once you have left our Websites or Mobile Apps, you should check the applicable privacy policy of the third party site to determine how they will handle or process any information they collect from you.
20. You should also be aware that some content delivered through our Websites and/or Mobile Apps may originate from a third party content provider. Such other content providers may place cookies on your computer or device, or otherwise gather information about you, including by asking you to provide information through the content player itself. Again, it is up to you to review the applicable terms of use and/or privacy policy of the providers of such content before providing your information to such third party content provider.
H. Retention of Personal Data
21. We will retain your Personal Data only for as long as it is necessary to fulfil the purpose for which it is collected or for any legal or business purposes, or as otherwise permitted or required to be retained under law, by a court or by a government.
I. Your Rights
22. Depending on the jurisdiction that you are in or where we operate, you may enjoy certain data subject rights under applicable law in relation to our collection, use and/or disclosure of your Personal Data. Such rights may include:
22.1 Right to withdraw consent: you may withdraw your consent to our collection, use and/or disclosure of your Personal Data at any time throughout the period that your personal data is in our possession or under our control. However, the withdrawal of your consent shall not affect any collection, use and/or disclosure of your Personal Data for which you had already consented to.
22.2 Right to access: you may (a) request access to your Personal Data that is in our possession or under our control; (b) request that we provide you with a copy of your Personal Data (that is in our possession or under our control) in documentary form; (c) request information about the ways in which your Personal Data (that is in our possession or under our control) has been or may have been used or disclosed by us within a year before the date of your request; and (d) request that we reveal how we obtained your Personal Data if such Personal Data was not obtained from you.
22.3 Right to correct: you may request that we correct any error or omission in your Personal Data that is in our possession or under our control. Where permitted by applicable law, in the event that we decide not to take any action on your request(s) to correct your Personal Data that is in our possession or under our control, we will record your request(s) along with the relevant reason(s) for our decision not to take action.
22.4 Right to deletion: under certain circumstances and where permitted by law, you may request that we delete, remove or anonymise your Personal Data that is in our possession or under our control.
22.5 Right to restriction: you may request that we suspend the processing of your Personal Data that is in our possession or under our control, for example, if you wish to establish its accuracy and to request the correction of any error or omission.
22.6 Right to data portability: under certain circumstances and where permitted by law, you may request that we transmit your Personal Data (that is in our possession or under our control) to a third party, in an automatic machine-readable or usable format that can be processed or disclosed by automatic means.
22.7 Right to object: where we are collecting, using and/or disclosing your Personal Data on the basis of a legitimate interest (or those of a third party), you submit a request to us in objection of such collection, use and/or disclosure.
22.8 Right to lodge a complaint: you have the right to file a complaint with the relevant competent authorities if you believe that our collection, use and/or disclosure of your Personal Data is in violation of any applicable laws.
23. If you wish to exercise any of your data subject rights, please contact our Data Privacy Officer / Personal Information Controller in accordance with paragraph 25 below. We may require that you submit certain forms or provide certain information (including proof that you are properly authorised and entitled to exercise the above right(s)) in order to process your request(s). Where permitted by applicable law, we may also charge you a fee to process your request(s).
